Hungary Supreme Court makes critical announcement

Portfolio
Hungary’s Curia (Supreme Court) is starting a comprehensive investigation into foreign currency lending, announced György Wellmann, head of the civil division at the institution’s annual progress report on Thursday. This marks a turnaround since the Curia is now going to investigate how banks had informed customers about exchange rate risks.
Pro-government daily Magyar Idők reported that
  • the consultative body will study in the first half of 2019 - among other things - what the risk exposure statements and prospectuses about exchange rate risks contained;
  • they will require the files of all litigations where the court ruled that there had been no proper awareness-raising regarding exchange rate risks.

The paper says that nearly 4,000 cases of FX mortgage borrowers will make it to the Curia this year, and in many of these look into warnings about exchange rate risks. The European Court of Justice also has about half a dozen cases from Hungarian FX mortgage borrowers and new guidances in these cases could be presented soon.

György Wellmann says the Curia will possibly change its previous resolutions for legal uniformity or even adopt new ones.
